MCA for Practitioner and Provider Services Part 3 DoLs /Awareness of LPS new legislation delivered by St Thomas Training

The half day training session will give participants an overall understanding of how the Deprivation of Liberty Safeguards (“DoLS”) apply to their day-to-day work settings.
NB: participants need to understand that a House of Lords report, followed by a Supreme Court judgement, both of which were published in March 2014, have fundamentally altered what DoLS are all about. Therefore this session is relevant even if you have previously attended DoLS training.
To give participants an understanding of how the new Liberty Protection Safeguards will apply to their work settings, and to examine what changes they need to make in order to manage the transition from DoLS to LPS. NB: At the time of writing this outline the Code of Practice, and various regulations, are still to be finalised with the implementation of LPS now delayed until April 2022.
Who should attend?
Social workers, care managers, independent support assistants and occupational therapists. It is essential for all participants to have a good understanding of the Mental Capacity Act 2005 prior to attending part 3.
This course is a virtual course run via Zoom or Teams - joining instructions will be sent to via diary invite a week before the course date. Please note, this course will have regular breaks for participants so please ensure you take yourself away from the screen. The course is aimed to be interactive.
What can I expect?
An interactive session aimed at encouraging participants to ask questions, make comments and bring up their own issues through the use of a range of different methods including quizzes, case studies, video clips and small group work as well as direct teaching.
What will I learn?
By the end of this session participants should:
• Know the definition of “deprivation of liberty” as set out in the Act
• Understand the identity of the Responsible Body, and appreciate how it can authorise the arrangements for care or treatment which give rise to a deprivation of liberty
• Be able to explain the purpose of the three specified assessments (the “Mental Capacity Assessment”, the “Medical Assessment” and the “Necessary and Proportionate Assessment”), and who can undertake these
• Understand the special arrangements for care homes
• Understand the how the “Pre-Authorisation Review” is carried out, and know what to do if the person objects to the proposed arrangements
• Be able to explain the purpose and roles of the Approved Mental Capacity Professional, the Independent Mental Capacity Advocate, and the Appropriate Person
• Understand the safeguards that are put in place by the authorisation, and be able to explain how the person can challenge an authorisation.
• Be able to explain how the LPS interfaces with the Mental Health Act 1983
• Know what parts (if any) of their existing DoLS policies/procedures they can use in relation to the LPS
• Have explored what actions they need to take now, and over the coming months, to manage the transition in their own work settings from the old DoLS to the new LPS
• Have examined and discussed various case studies and examples relevant to their work settings
